Legislation Promised for Personal Injury Claims Companies

Lord Falconer promises legislation to regulate the personal claims industry

The lord chancellor, Lord Falconer, has promised legislation to clamp down on 'frivolous' cases and hard sell tactics by personal injury claims companies.

Falconer called for voluntary legislation last year, but says he has been 'disappointed' by the results as only a small proportion of companies have joined the voluntary standards body.

Also, high street canvassers have continued to solicit 'have a go' cases with hard sell tactics that do not give full information to the complainants, clogging up the system for genuine claims.

The industry will now be overseen by a new Legal Services Board with statutory powers, a move that has been welcomed by the Association of Personal Injury Lawyers and the Association of British Insurers.
