Insurance Companies Win Mesothelioma Claims Appeal

Thousands of widows will miss out on full compensation as insurers win Law Lords appeal

The Law Lords have ruled in favour of an insurance industry challenge to a previous ruling which allowed widows of mesothelioma victims to claim full compensation from employers, when it could not be proved which of several employers of the sufferer was specifically responsible for the illness being contracted.

The ruling will impose a compensation cap on the claims of victims who may have been exposed to asbestos fibres while working for more than one company, or while self employed, and so could not definitively say that a particular employer was 100% responsible for the illness.

The ruling is likely to save the insurance industry millions of pounds, but has been described as 'an insult' to the bereaved families by the president of the Association of Personal Injury Lawyers, Richard Langton.
