Court Rules Asbestos Compensation Can Continue

Thousands of workers exposed to asbestos can continue to claim compensation, high court rules

The high court has ruled that thousands of workers exposed to asbestos can continue to claim compensation, after a bid by insurers led by Norwich Union to tighten up the liability criteria failed.

The test case involved 10 men who had the medical condition pleural plaques, a benign scarring of lung tissue caused by asbestos exposure. The insurers argued that this condition was not an injury as there are no physical symptoms, but this was rejected.

The judge, however, ruled that levels of asbestos compensation should be reduced by approximately 50%.

The decision is expected to cost insurers hundreds of millions of pounds, with around 14,000 claims a year expected for the next 35 years.
